By accessing or using any services provided by BooBaDo LLC ("BooBaDo", "AiThlete", "we", "us", or "our"), including the AiThlete mobile application, AiThlete.Club web platform, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. These Terms apply to all users of our Services, including athletes, coaches, club administrators, and visitors. By using our Services, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms.
Account Registration and Responsibilities
Account Creation
- You must provide accurate, current, and complete information during registration
- AiThlete.Club accounts require a valid email address for magic link authentication
- Club administrators and coaches may opt for password authentication
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized access to your account
User Responsibilities
- You are responsible for all activities that occur under your account
- You may not share your account with others or transfer it without our permission
- You must comply with all applicable laws and regulations
- You must not use the Services for any illegal or unauthorized purpose
- You agree to use the Services only for their intended purpose of fitness training and athletic development
AI Services and Usage
Our Services incorporate artificial intelligence ("AI") to provide personalized training recommendations, workout plans, and coaching insights. By using our AI-powered features, you understand and agree that:
- AI recommendations are for informational purposes only and should not replace professional medical or training advice
- You should consult with healthcare professionals before beginning any fitness program
- AI-generated content is based on the information you provide and may not be suitable for all individuals
- We do not guarantee specific results from following AI recommendations
- You use AI-generated training plans and recommendations at your own risk
- AI features may be limited or unavailable in the free tier of the AiThlete mobile application
- We continuously improve our AI models but do not use your personal data to train them
Use of Services
Permitted Use
- Personal fitness training and athletic development
- Tracking workout progress and performance metrics
- Accessing AI-powered coaching recommendations
- Managing athlete profiles (for authorized coaches and club administrators)
- Participating in club activities and programs
- Communicating with coaches through approved channels
Subscription and Payments
- Certain features require a paid subscription
- Subscription fees are billed in advance on a recurring basis
- You authorize us to charge your payment method for all fees
- All fees are non-refundable except as required by law
- We may change subscription prices with 30 days notice
- Free tier users have limited access to premium features
Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Violating any laws, regulations, or third-party rights
- Using the Services to harm, threaten, or harass others
- Impersonating another person or entity
- Attempting to gain unauthorized access to our systems or other users' accounts
- Reverse engineering, decompiling, or disassembling our software
- Using automated systems or bots to access the Services
- Collecting or harvesting user data without permission
- Uploading malicious code, viruses, or harmful content
- Interfering with the proper functioning of the Services
- Using the Services for commercial purposes without authorization
- Sharing false or misleading information about your fitness level or health status
- Circumventing any security features or access controls
Intellectual Property Rights
Our Property
- All content, features, and functionality of the Services are owned by BooBaDo LLC
- Our Services are protected by copyright, trademark, and other intellectual property laws
- The AiThlete name, logo, and all related names, logos, and designs are our trademarks
- You may not use our intellectual property without express written permission
Your Content
- You retain ownership of content you submit to the Services
- You grant us a license to use, store, and display your content as necessary to provide the Services
- You represent that you have the right to submit any content you provide
- We may remove content that violates these Terms or is otherwise objectionable
Health and Safety Disclaimers

- The Services are not a substitute for professional medical advice, diagnosis, or treatment
- Always consult your physician before beginning any exercise program
- Stop exercising immediately if you experience pain, dizziness, or discomfort
- We are not responsible for injuries resulting from use of the Services
- You assume all risks associated with your use of fitness recommendations
- The Services are not intended for use by individuals with serious health conditions without medical supervision
- Minors should use the Services only with parental consent and supervision
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOBADO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold harmless BooBaDo LLC, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Services.
Privacy and Data Protection
Your use of our Services is also governed by our Privacy Policy. By using the Services, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy. We are committed to protecting your privacy and do not sell or share your personal data with third parties for their marketing purposes.
Modifications to Services
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.
Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will cease immediately. All provisions of these Terms that should reasonably survive termination shall remain in effect.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in Colorado, except where prohibited by law.
Service Availability
The Services are currently available only in the United States. We make no representations that the Services are appropriate or available for use in other locations. Access to the Services from territories where their contents are illegal is prohibited.
Third-Party Services
Our Services may contain links to third-party websites or services that are not owned or controlled by BooBaDo LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
Changes to Terms
We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after any changes indicates your acceptance of the new Terms.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and BooBaDo LLC concerning the use of our Services.
